Providence, RI – David Swain, the former Jamestown town councilor whose murder conviction was overturned in September, is in trouble with the law again. Portsmouth police charged him with drunk driving early Sunday morning. Portsmouth police Lt. Brian Peters says Swain nearly clipped a police cruiser around 1:45 AM Sunday while making a wide right turn from East Main Road onto Union Street. Swain failed a field sobriety test and refused a breath test.
Swain has only been back in Rhode Island for a few of months. He was convicted of killing his wife, Shelly Tyre, in a scuba diving incident in the British Virgin Islands in 1999. His conviction was overturned in September because of a problem with jury instructions.
